Terms and Conditions (Competition Rules)

  1. The Contest is open to all UK residents aged 16 years old on the date of entry, excluding employees and their immediate families of PepsiCo International Limited ("PepsiCo"), its affiliates, subsidiaries, successors or assigns, service agencies or independent contractors of these organisations, and anyone professionally connected with the Contest. Any entrants under 16 should sign and send a completed Parental/Legal Guardian Consent Form to confirm entry to the Contest and acceptance of the rules of the Contest and these Terms and Conditions. PepsiCo reserves the right to confirm that such authorisation has been given, and to disqualify any contestant under 16 who fails to provide such authorisation. Entries must be submitted by 11.59:59pm (GMT) on 16 January 2007 (the “Closing Date”). Entry limited to one entry per person or team. By entering the Contest, each contestant agrees and acknowledges that PepsiCo is permitted to receive his/her registration data. All personal information will be used by PepsiCo in accordance with its privacy policy.
  2. No purchase necessary.
  3. To enter, you must upload your video, image or textual via the following website: www.maxyourteam.co.uk (the "Website"), following the on-screen instructions carefully. Entries should be based on the "MaxYourTeam" theme, information on which can be found on the Website.

    Entries will be judged from midnight on 12 December 2006 to the Closing Date. The winning entry will be selected on the basis of the highest average rating for the entry, as chosen by other users of the Website, and will receive the grand prize (as described in paragraph 14 below). Each entry has to be rated at least 10 times to be eligible for the grand prize. No cash alternative or other prize alternatives are available for the grand prize.
  4. PepsiCo will monitor the number of ratings and general activity on the Website. PepsiCo reserves the right, in its sole discretion, to disqualify and remove any entry that does not comply with the following requirements, even after the entry is submitted on the Website. PepsiCo will not take part in dialogue with any contestant who has been refused entry or otherwise:
    • Entries that have been previously published, released or distributed in any form or which have previously won any award. Entries must be original and your own work.
    • Entries containing personally identifiable information about the submitter or any other person(s).
    • Entries containing any infringing, threatening, false, misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content.
    • Entries containing any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
    • Entries which infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or which violate any person's rights of privacy or publicity. This means, for example, that entries must not include:
      • trademarks owned by third parties;
      • copyrighted materials owned by third parties (including movie dialogue or musical compositions); and/or
      • names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead.
    • Entries in which a contestant has purchased or secured the rights to use stock footage or existing music.
    • Entries which contain any commercial content that promotes any product or service other than that of PepsiCo. Entries must not contain screen credits.
  5. Each contestant submitting an entry represents and warrants that:
    • They have all the necessary rights to enter the Contest and have their entry displayed on the Website.
    • The entry does not contain or infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity. Each contestant agrees to fully indemnify PepsiCo in respect of all royalties, fees and any other monies owing to any person by reason of the contestant breaching any of the foregoing.
    • Each person depicted in the entry has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained.
    • If the entrant is under 16, he/she has his/her parent’s consent to participate in the Contest. Download a Parental/Legal Guardian Consent Form.
  6. If there is sufficient evidence to suggest malpractice and manipulation of the rating process then PepsiCo has the right to remove the relevant entry or entries and, if necessary, award the prize to a different contestant. PepsiCo’s decisions are final.
  7. If PepsiCo does not receive a valid signed Parental/Legal Guardian consent form for any winner under 16 within 7 days of the contestant being declared a winner for a particular day (excluding the day on which such declaration is made by PepsiCo). PepsiCo will be entitled to select an alternative winner from among the contestants.
  8. By submitting an entry for the Contest, each contestant hands over the worldwide rights, including all intellectual property and interest that is created from or in connection with participation in the Contest or acceptance or use of any prize, to PepsiCo. PepsiCo shall own the copyright in each entry and each contestant waives the right of ownership for the submission in respect of commercial use, marketing and advertising. from any and all liability or injuries, loss or damage of any kind arising from or in connection with participation in the Contest or acceptance or use of any prize
  9. PepsiCo assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Contest, and PepsiCo assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Contest. If for any reason, programs are not capable of running as planned, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of PepsiCo which corrupt or affect administration, security, fairness, integrity, or discretion, PepsiCo reserves the right to cancel, terminate, modify or suspend the Contest. PepsiCo assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries. PepsiCo is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to PepsiCo on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to the contestant’s or any other person's computer related to or resulting from participation or downloading any materials in the Contest. If for any reason a contestant’s entry cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, PepsiCo assumes no responsibility.
  10. In no event will PepsiCo, its parents, affiliates, subsidiaries and related companies, its advertising or promotion agencies, or its officers, directors, employees, shareholders, representatives or agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any contestant’s access to and use of the Website. Without limiting the generality of the foregoing, everything on the Website is provided “as is”, without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose or use or non-infringement.
  11. In entering the Contest, each contestant agrees to participate in related publicity and to the use of names, images and likenesses for the purposes of advertising, promotion and publicity without additional compensation. The entrant/team that wins the grand prize must be available to take part in a photo-shoot during the week commencing 22 January 2007. By entering, each contestant releases and holds harmless PepsiCo, its parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or injuries, loss or damage of any kind arising from or in connection with participation in the Contest or acceptance or use of any prize to the greatest extent as permitted by law.
  12. The grand prize consists of the following:
    • VIP tickets to a film or music premiere, and an invitation to an after-show party or members bar;
    • A small, professionally-designed tattoo for each team member (subject to a maximum of 11 people);
    • One copy of the autobiography of one member of the winning team; and
    • One session (per team member) with a professional gym instructor.
  13. The winning contestant will be notified by email. The name of the winning entry will be posted at www.maxyourteam.co.uk on or around 16th January 2007, and can also be obtained from PepsiCo on request.
  14. Every person who rates an entry to the Contest will be entered into a daily prize draw to win a Logitech Quickcam Pro 5000 webcam. Winners will be notified by email, and prizes will be sent out after the final entry to the Contest is submitted before the Closing Date. The prize will not be redeemed in cash, and is not transferable, at the request of a prize-winner. However, if due to circumstances beyond its control PepsiCo is unable to provide the Logitech webcam to a prize-winner, PepsiCo reserves the right to award a substitute webcam product of equivalent value.
